This proposed rule would require health care and social assistance employers to develop and implement comprehensive workplace violence prevention plans. With workplace violence incidents in health care settings having increased by over 60 percent in recent years, the rule targets hospitals, nursing facilities, home health agencies, and social service organizations.
Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings
This proposed rule would establish the first federal standard to protect approximately 36 million indoor and outdoor workers from heat-related injuries, illnesses, and deaths. Employers would be required to develop heat illness prevention plans, provide water and shade, allow rest breaks, and implement acclimatization protocols when the heat index reaches specified thresholds.
Non-Compete Clause Rule; Trade Regulation Rule on Non-Compete Clauses
This notice announces the FTC's final non-compete clause rule, which would prohibit employers from entering into or enforcing non-compete agreements with most workers. The notice also addresses the multiple legal challenges filed against the rule and the preliminary injunctions that have been issued by federal courts, effectively blocking the rule from taking effect nationwide.
Employee or Independent Contractor Classification Under the Fair Labor Standards Act
This final rule restores the multifactor economic reality test for determining whether a worker is an employee or independent contractor under the Fair Labor Standards Act. The rule rescinds the previous administration's simplified two-factor test and returns to a totality-of-the-circumstances analysis, considering six factors including opportunity for profit or loss, investment, permanence, and the degree of employer control.
